Expunction and orders of non-disclosure are similar in that they both seal criminal records from public view, however there are key differences:
- Orders of non-disclosure prohibit the release of criminal record information to the public, including potential employers. Your case will not appear in any background checks done by private employers. Those eligible for non-disclosure include individuals whose case was dismissed following deferred adjudication.
- Expunction (or expungement) completely erases the charge from all private, municipal and public records. A case is eligible for expungement if it was dismissed or if the individual was found not guilty.
