Who is eligible for the diversion program?
While qualification varies according to the facts of the case, in general, people eligible for the drug diversion program include first-time offenders and some subsequent offenders charged with less serious drug crimes, including:
- Possession of small amounts of marijuana and other drugs
- Driving while impaired by drugs
- Prescription drug crimes
- Drug sales and distribution under a certain amount
Note: Those caught with a large amount of drugs in their possession, heavy drug dealers and other serious drug crime offenders are not eligible for the diversion program.
What is involved in the drug diversion program?
A special division of the court (DIRECT) handles diversion program cases outside of the normal criminal process. It was designed on the belief that some drug crimes do not warrant severe criminal punishment.
Those who qualify will be in the program for six months for a misdemeanor drug conviction or one year for a felony conviction. During the program's duration, individuals will submit to extensive drug testing and attend regular narcotics meetings. The required drug tests lessen every three months, preparing an individual for making decisions without direct accountability. Upon completion of the program, the charges are dismisses and the record may be eligible for expunction.
While the program does cost $1,000, this is much cheaper than the fines and court fees one would pay if going through the criminal system. In addition, individuals get a chance to correct their behavior and move forward without the stigma of a criminal background.
